1. Acceptance of Terms

• These Terms of Service (“Terms”) govern your access to and use of Fantasy AI: Roleplay & Companions (the “Service”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

• We may update these Terms from time to time. Material changes will be notified in-app or through other reasonable means. Continued use after changes become effective constitutes acceptance.

1. Service Description and Important Notices

• The Service offers AI-powered roleplay chat, AI image generation, and character creation. It includes a virtual currency (“Gems”) used to unlock or extend chats and related features.

• AI outputs (text or images) may be inaccurate, biased, or inappropriate. They are provided for entertainment and creative purposes only and do not constitute professional advice (medical, legal, financial, psychological, or otherwise).

• Do not rely on the Service for emergencies. If you are in crisis or need urgent help, contact local emergency services.

1. Eligibility and Accounts

• You must be at least 13 years old to use the Service. In the EEA/UK and certain regions, you must meet the local minimum age (often 16). Access to adult/explicit content (if any) requires you to be at least 18 and to confirm this setting explicitly.

• You are responsible for all activity under your account and for maintaining account security. Notify us immediately of any unauthorized use.

1. Virtual Currency and In-App Purchases (Gems)

• Nature of Gems: Gems are a limited, non-transferable, revocable, non-sub-licensable, and non-exclusive right to access certain in-app features. They have no real-world monetary value, are not redeemable for fiat currency, and cannot be transferred or sold outside the Service.

• Purchases and pricing: Purchases are processed by the platform (e.g., Apple App Store/Google Play). Prices, taxes, and currency are as displayed at purchase time.

• Delivery and consumption: After a successful purchase, Gems will be credited to your account. Use of certain features consumes Gems according to the in-app rules and descriptions.

• Changes: We may modify Gem pricing, packages, consumption rules, or availability. We will provide notice in-app where required.

• Refunds: Except where required by law or platform policy, all sales are final. For issues such as duplicate charges or uncredited Gems, please contact the platform first and/or email us.

• Fraud and chargebacks: We may investigate and take action to prevent fraud or abuse, including reversing credits, restricting features, freezing balances, or suspending/terminating accounts.

1. Your Content, Outputs, and Licenses

• Your inputs: You retain any rights you have to content you submit (e.g., prompts, messages, character cards, uploads).

• License to us: You grant us a worldwide, non-exclusive, royalty-free, transferable and sub-licensable license to host, store, process, reproduce, modify (for technical formatting), display, and distribute your content as necessary to operate, maintain, and improve the Service. We will only use your content to train or improve models if you have explicitly opted in.

• AI outputs: To the extent permitted by law, as between you and us, you may use the outputs generated from your inputs for any lawful purpose, subject to these Terms and third-party rights. Outputs may be similar or identical to outputs generated for others. Do not include confidential or sensitive information in your inputs.

• Your promises: You represent and warrant that you have the necessary rights to your content and that it does not infringe or violate any third-party rights (e.g., privacy, publicity, copyrights, trademarks).

• Image generation and uploads: You must not generate or upload unlawful, infringing, non-consensual, or misleading images (including deepfakes), or use protected logos/marks without permission. You must not create sexual or sexually suggestive content involving minors.

1. Acceptable Use and Safety You agree not to:

• Violate any laws or third-party rights, including intellectual property, privacy, and publicity rights.

• Post or generate content that is illegal, exploitative, sexually explicit involving minors, or otherwise harmful; harassment, hate, threats, or incitement of violence; terrorist or criminal advocacy; doxxing or invasion of privacy.

• Promote self-harm or dangerous activities. If you are in crisis, contact local emergency services.

• Attempt to bypass safety filters, abuse rate limits, scrape or harvest data, reverse engineer, interfere with the Service, or access it in unauthorized ways.

• Spam, run bots at scale, or otherwise abuse the Service or its resources. We may use automated and manual moderation, and we may remove content, restrict features, or suspend/terminate accounts for violations. You may appeal via support.

1. License to Use the Service

• Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to install and use the App on devices you own or control, solely for personal, non-commercial use (unless we expressly permit otherwise).

1. Intellectual Property

• The Service, including software, interfaces, trademarks, logos, and content provided by us or our licensors, is protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from the Service.

• You may share screenshots or outputs you have rights to share, provided you comply with these Terms and applicable laws.

1. Feedback

• If you provide suggestions or feedback, you grant us a perpetual, worldwide, royalty-free license to use and incorporate them without obligation to you.

1. Third-Party Services and Links

• The Service may integrate third-party services (e.g., app stores, cloud hosting, AI inference, analytics, moderation). Their terms and policies apply to their services. We are not responsible for their availability or practices.

1. Reporting and Rights Protection (Copyright/Portrait/Trademark)

• To report alleged infringement, email gubeez2020@gmail.com with: (a) proof of ownership or authorization, (b) specific links/screenshots, (c) your contact information, and (d) a clear description of the issue. We will review and respond within a reasonable time.

1. Suspension and Termination

• We may suspend or terminate your access immediately if you materially or repeatedly violate these Terms or applicable laws, or if necessary for safety, security, or legal compliance.

• You may stop using the Service at any time and may request account deletion in-app (if available) or by contacting us. We process deletion requests according to our Privacy Policy.

1. Disclaimers

• The Service is provided “as is” and “as available.” We make no warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or availability.

• AI outputs may be inaccurate or offensive; we do not guarantee correctness, completeness, or suitability for any purpose.

1. Limitation of Liability

• To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill.

• Our aggregate liability for direct damages arising out of or related to the Service will not exceed the greater of: (a) the amounts you paid to us for the Service in the six (6) months before the claim, or (b) USD $50 (or equivalent), unless applicable law provides otherwise.

1. Indemnification

• You agree to indemnify and hold harmless us and our affiliates, partners, and personnel from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the Service, or your violation of these Terms or applicable laws.

1. Governing Law and Dispute Resolution

• These Terms are governed by the laws without regard to conflict of laws principles.

• Disputes shall be resolved . If you are a consumer, mandatory protections under your local law may apply.

1. Miscellaneous

• Severability: If any provision is found invalid or unenforceable, the remaining provisions will remain in full force.

• Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or reorganization.

• Entire agreement: These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Service.

• No waiver: Failure to enforce a provision is not a waiver of our right to do so later.

• Survival: Provisions that by their nature should survive termination will survive (e.g., IP, disclaimers, limitations of liability, indemnity).
